This privacy policy (“Privacy Policy”) governs how Hirestance, Inc., (hereinafter referred to as “Hirestance”, “we”, “our” or “us”) collects, uses and shares personal information:

 

about each Employer (as defined under Hirestance’s Terms of Service), Candidate (as defined under Hirestance’s Terms of Service), user or visitor (collectively “you” or “your”); and/or

 

you provide to Hirestance when (i) accessing Hirestance’s website located at https://hirestance.com (hereinafter referred to as “Website”), and/or (ii) using the Services (as defined under Section 3.2 of Hirestance’s Terms of Service) on the Platform (as defined under Section 3.1 of Hirestance’s Terms of Service) via the Website.

 

Hirestance is committed to safeguarding your privacy, as such this Privacy Policy, together with the Website Terms of Service, sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us.

 

By accessing the Website and using the Services on the Platform (via the Website), you accept the terms and conditions of Hirestance’s Privacy Policy, and you consent to Hirestance’s collection, storage, use and disclosure of your Personal Information (defined below) as described in this Privacy Policy.

This Privacy Policy applies only to your access to the Website and your use of the Services on the Platform. The Website may contain links to third party websites and resources. Hirestance has no control over how your information is collected, stored, or used by these third party websites and/or resources. Collection of Personal Information

 

Hirestance collects the following information from you:

 

personal information that could identify you, which includes your name, surname, email address, gender, location, birth date, nationality, ethnic group, sexual orientation, languages, marital status, disability information, professional background, and/or LinkedIn profile when you register a User Account (as defined under Section 4.1 of Hirestance’s Terms of Service) on Hirestance Website;

 

contact information which includes data such as billing address, email address, telephone numbers and any other data you have provided to us in order for us to be able to provide you with the Services on the Platform (via the Website);

 

Your financial data such as your payment card details;

 

transaction data which includes details about payments or communications to and from you as well as data about the Services you have subscribed for; and

 

technical data which includes your Internet protocol address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Website,

 

(collectively “Personal Information”).

 

In the context of the law and this notice, the term “process” and “processing” means collect, store, transfer, use or otherwise act on data.

Hirestance’s use of your Personal Information will always have a lawful basis, being either that (i) we have a contractual obligation with you as pertains to the provision of the Services; or (ii) because you have consented to our use of your Personal Information; or (iii) for our legitimate interests; or (iv) we have a legal obligation to divulge your Personal Information. More specifically, Hirestance may use your Personal Information for the following purposes:

 

 

(i)          Personal Information we process because we have a contractual obligation with you: When you subscribe to a Service on Hirestance’s Website, or otherwise agree to the Website Terms of Service, a contract is formed between you and Hirestance. In order to carry out our obligations under that contract we must process the Personal Information you provide to us. We may use your Personal Information to: verify your identity for security purposes; sell Services to you; and/or provide you with our Services on the Platform. Hirestance shall continue to process your Personal Information until the contract between us ends or is terminated by either party in accordance with our Website Terms of Service.

 

(ii)         Personal Information we process with your consent: When there is no contractual relationship between Hirestance and you, and through certain actions such as when you browse the Website or ask us to provide you with more information about our Services, you provide your consent for Hirestance to process your Personal Information. Wherever possible, Hirestance aims to obtain your explicit consent to process your Personal Information. We may continue to process your Personal Information on this basis until you withdraw your consent. You may withdraw your consent at any time by sending us an email at info@hirestance.com. However, if you do so, please note that you may not be able to use the Website or make use of the Services on the Platform further.

 

(iii)        Personal Information we process for the purposes of legitimate interests: Hirestance may process Personal Information on the basis that there is a legitimate interest (for example, for recordkeeping purposes, obtaining insurance advise and professional advice.) either to you or to us. Where we process your Personal Information on this basis, we shall do so after having given careful consideration to whether: (a) the same objective could be achieved through other means; (b) processing or not processing the Personal Information might cause you harm; (c) you would expect Hirestance to process your Personal information, and (d) you would, consider it reasonable for us to process your Personal information.

 

(iv)        Personal Information we process because we have a legal obligation: Hirestance may have to process your Personal Information in order to comply with a statutory obligation, which may include, but not be limited to providing your Personal Information to legal authorities upon a legal request to do so.

 

(v)         Personal Information we process for the purposes of connecting you with our service providers: To facilitate the provision of the Services by Hirestance to you, we work with a number of service providers, who process data on our behalf. Our service providers include payment gateway providers (including but not limited to Stripes), subscription management providers, email service providers, and analytical tool providers.

 

 

Automatic Collection of Information

 

When you visit the Website, Hirestance’s servers automatically record information about your computer hardware and software. This information is collected automatically and is used only to identify potential cases of abuse, resolve technical issues, optimizing the performance of the Website for a better user experience, and establish statistical information regarding your use of the Website and the Services on the Platform. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.

 

 

Storing Personal Information

 

Subscription plan information and payment information is stored and secured on www.stripe.com. All Personal Information is stored on a dedicated server and in a backup vault.

 

Should Hirestance store your Personal Information outside the European Economic Area (“EEA”), we shall take all reasonable steps to ensure that your Personal Information is treated as safely and securely as it would be within the EEA including but not limited to, complying with the same laws that are in place within the EEA as pertains to the security of your data; and only using verified security-hosting companies who have the applicable security and safety measures in place.

 

 

Security

 

Hirestance implements security measures that include encryption, SQL injection, password management and secure socket layer technology, which are designed to protect your information from unauthorized access and potential security breaches.

 

Payment information is securely stored by Stripe and cannot be accessed by Hirestance.

 

However, you acknowledge that no data transmission over the Internet or wireless network can be guaranteed. Therefore, while Hirestance strives to protect your Personal Information, you acknowledge that

 

there are security and privacy limitations of the Internet which are beyond our control;

 

the security, integrity, and privacy of any and all information and data exchanged between you and another registered user on the Platform (via the Website and/or the Services) cannot be guaranteed; and

 

any such information and data may be viewed or tampered with in transit by a third-party, despite Hirestance’s best efforts.

 

 

Your Rights regarding the General Data Protection Regulation

 

For the purposes of complying with the General Data Protection Regulation 2016/679 (“GDPR”), Hirestance is considered as the data controller in relation to your Personal Information. We have listed below, the principal rights you have under the GDPR:

 

 

(i)          the right to access – you can ask for copies of your Personal Information;

 

(ii)         the right to rectification – you can ask us to rectify inaccurate Personal Information and to complete incomplete Personal Information;

 

(iii)        the right to erasure – you can ask us to erase your Personal Information from our systems;

 

(iv)        the right to restrict processing – you can ask use to restrict the processing of your Personal Information;

 

(v)         the right to object to processing – you can object to the processing of your Personal Information;

 

(vi)        the right to data portability – you can ask us to transfer your Personal Information to another organization or to you;

 

(vii)       the right to complain to a supervisory authority – you can complain about our processing of your Personal Information to the applicable authorities; and

 

(viii)      the right to withdraw consent – you can request that we withdraw your consent to store and process your Personal Information except to the extent that the basis of our processing your Personal Information is required by law.

Should you have any cause for complaint about our use of your Personal Information, please contact Hirestance using the details provided below and we will endeavour to solve the problem for you.

 

 

Your Rights under the California Consumer Privacy Act

 

To the extent that the California Consumer Privacy Act (“CCPA”) is applicable to either Hirestance or you: both parties agree to comply with all of its obligations under the CCPA; and in relation to any communication of ‘personal information’ as defined by the CCPA, the parties agree that no monetary or other valuable consideration is being provided for such personal information and therefore neither party is ‘selling’ (as defined by the CCPA) personal information to the other party.

 

The principal rights you have under the CCPA include but are not limited to:

 

the right to know the Personal Information we collect form you;

 

the right to request the deletion of your Personal Information;

 

the right not to be discriminated against for having exercised your rights under the CCPA;

 

the right to opt out from the collection/sale of your Personal Information; and

 

the right to access your Personal Information.

 

Both parties agree to notify the other immediately if it receives any complaint, notice, or communication that directly or indirectly relates to either party’s compliance with the CCPA. Specifically, Hirestance shall notify you within ten (10) working days if we receive a verifiable consumer request under the CCPA.

 

 

Analytical Data from Third Parties

 

Hirestance may collect or receive information that third party service providers may provide about you when using the Website and/or the Services on the Platform. Or Hirestance may obtain information from other sources and combine that with information Hirestance collects through your use of the Services. We use Stripe as a payment gateway provider. Stripes may collect information you provide to us as a means of processing payments you make on the Website for the Services.

You can stop all collection of Personal Information by Hirestance by not accessing the Website, Platform and the Services, or by requesting to opt-out via email, at info@hirestance.com.

Hirestance may update this Privacy Policy from time to time in Hirestance’s sole discretion and will notify you of any material changes to the way in which Hirestance treats Personal Information. When changes are made, Hirestance will revise the updated date at the bottom of this page. Hirestance may also provide notice to you in other ways in Hirestance’s sole discretion, such as through the contact information you have provided. Any updated version of this Privacy Policy will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified.
